Welcome to skylinetentcompany.com (the “Site”), operated by Skyline Tent Company (“Skyline,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and any content, inquiry forms, galleries, and informational materials made available through it.
Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them. If you do not agree, do not use the Site.
1. Relationship to Rental and Service Agreements
These Terms govern your use of the Site only.
Any tent rental, structure installation, equipment rental, design service, or event production engagement is governed by a separate written proposal, quote, and rental/services agreement signed by you and Skyline (the “Rental Agreement”). In the event of any conflict between these Terms and a signed Rental Agreement, the Rental Agreement controls with respect to that engagement.
Nothing on the Site — including pricing references, FAQs, blog articles, gallery images, or capacity guidance — constitutes a binding offer, quotation, or guarantee of availability, pricing, or performance.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts to use the Site or submit an inquiry. If you use the Site on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
3. Permitted Use of the Site
You may view, download, and print Site content for your own personal, non-commercial use in planning an event. You may not:
- Copy, reproduce, republish, distribute, or commercially exploit Site content without our prior written consent
- Use our photographs, tent designs, renderings, or copy in your own marketing materials or listings
- Use automated systems (bots, scrapers, crawlers) to harvest content, images, or contact data, except for well-behaved search engine indexing
- Attempt to gain unauthorized access to the Site, its servers, or connected systems
- Introduce malware, viruses, or any code designed to disrupt or damage the Site
- Interfere with the Site’s operation, security features, or availability
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate any person or misrepresent your affiliation with any entity
- Submit false, misleading, or fraudulent inquiries
We may suspend or terminate your access to the Site at any time, without notice, for any violation of these Terms.
4. Intellectual Property
All content on the Site — including text, photographs, event galleries, renderings, layouts, graphics, logos, the Skyline Tent Company name and marks, video, and the compilation and arrangement of all of it — is owned by Skyline, its affiliates, or its licensors, and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
Event photography. Images displayed in our galleries depict past installations and may include work by third-party photographers, planners, florists, and vendors. Those images are used under license and may not be reproduced.
No license or right to any Skyline trademark or content is granted except as expressly stated in these Terms.
5. Submissions and Inquiries
When you submit an inquiry, consultation request, blog comment, review, photograph, floor plan, or other material through the Site (“Submission”), you:
- Represent that you own or have the right to submit the material and that it does not infringe any third party’s rights
- Grant Skyline a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display the Submission for the purpose of responding to your request, delivering our Services, and, where you have granted separate permission, for marketing
- Agree not to submit anything unlawful, defamatory, obscene, harassing, or infringing
We are not obligated to publish, retain, or respond to any Submission, and we may remove content at our discretion. Do not submit confidential information, payment card numbers, or sensitive personal data through Site forms.
Our handling of personal information in Submissions is described in our Privacy Policy.
6. Careers Submissions
Materials you submit through our Careers page are considered for employment purposes only and do not create an employment relationship, offer, or promise of consideration. Employment with Skyline, where offered, is at-will and governed by separate documentation.
7. Quotes, Availability, and Pricing
- Quotes and proposals are estimates based on the information you provide and are valid only for the period stated on the quote.
- Availability of tents, structures, and equipment is not reserved until a signed Rental Agreement and required deposit are received.
- Pricing is subject to change based on final guest count, site conditions, layout revisions, permit requirements, delivery distance, labor schedules, seasonal demand, and fuel or material costs.
- Sizing, capacity, and wind-rating information on the Site is general guidance only. Actual specifications depend on the specific structure, site survey, anchoring method, and engineering review.
- Deposits, cancellation windows, rescheduling terms, security deposits, damage waivers, and refund policies are set out in the Rental Agreement.
8. Site Conditions, Permits, and Safety
Informational content on the Site regarding permits, anchoring, weather resistance, fire safety, and capacity is provided for general education and does not constitute engineering, legal, or code-compliance advice for your specific project.
For any engagement, responsibilities including site access, ground conditions, utility locating and marking, permit applications, venue approvals, and evacuation planning are allocated in the Rental Agreement. Weather-related decisions — including delay, modification, or evacuation of a structure — are governed by the safety provisions of that agreement and applicable authority-having-jurisdiction requirements.
9. Third-Party Links and Partners
The Site links to third-party websites, partner vendors, and social media platforms. These links are provided for convenience only. We do not control, endorse, or assume responsibility for third-party content, products, services, or privacy practices. Your dealings with third parties are solely between you and them.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SKYLINE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site is free of viruses or harmful components. We do not warrant the accuracy, completeness, or currency of any information on the Site, including blog articles, FAQs, sizing guidance, and pricing references.
This section does not disclaim any warranty expressly provided in a signed Rental Agreement.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYLINE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Liability arising from a signed Rental Agreement is governed by that agreement, not this section. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Skyline, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any Submission you provide.
13. Electronic Communications
By using the Site or contacting us, you consent to receive communications from us electronically. You agree that electronic communications, agreements, and notices satisfy any legal requirement that such communications be in writing. Electronic signatures on proposals and Rental Agreements have the same legal effect as handwritten signatures.
14. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. You agree that any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Charlottesville or Albemarle County, Virginia, and you consent to personal jurisdiction there.
[OPTIONAL — discuss with counsel] If you wish to require binding arbitration and waive class actions, insert an arbitration clause here. Arbitration clauses must be conspicuous and are subject to specific drafting and notice requirements. Do not add one without legal review.
15. General Provisions
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign them freely in connection with a merger, acquisition, or sale of assets.
- Entire agreement. These Terms, together with our Privacy Policy and any applicable Rental Agreement, constitute the entire agreement between you and Skyline regarding the Site.
- Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including severe weather, natural disasters, labor disputes, supply shortages, utility failures, government action, or public health emergencies.
- Headings. Section headings are for convenience only and do not affect interpretation.
16. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page and revising the “Last Updated” date. Changes take effect upon posting. Your continued use of the Site after changes are posted constitutes acceptance. We encourage you to review these Terms periodically.
